New York applies the federal OSHA rule (29 CFR 1910.151(b)) with no fixed ratio: private employers fall under federal OSHA directly and public employers under PESH, and where no medical facility is in near proximity at least one adequately trained first-aider is required on a performance basis (3-4 minute response for serious-hazard sites).
Under 18 NYCRR (OCFS regulations, e.g. Part 418-1 for day care centers), every child day care program must have at least one staff person holding a valid CPR and first aid certificate appropriate to the ages of children in care, on premises during all operating hours.
New York's Good Samaritan law (N.Y. Public Health Law § 3000-a) makes anyone who voluntarily renders first aid or emergency treatment at the scene, without expectation of compensation, liable only for gross negligence; there is no legal duty to rescue.
The New York State Board of Nursing (NYSED, Office of the Professions) sets no general contact-hour quota for registered nurses but mandates topic-specific coursework, so a CPR/BLS course does not substitute for those mandates; advanced home health aides must hold a current CPR/BLS certification before beginning their training.
In New York adult care facilities, assisted-living residences and home-care agencies expect care staff to hold CPR and first-aid training; Advanced Home Health Aides must hold a current CPR/BLS certification before starting coursework, while for base aide roles CPR is commonly employer-required though not state-mandated.
Foster parents in New York are certified or approved under 18 NYCRR Part 443, and authorized agencies must provide preparatory training; a current first-aid and CPR certificate is commonly required by the certifying agency before and during a placement, recognized by OCFS.
Online CPR and first aid training is recognized in New York, with no ban on online training for workplace first-aiders; online theory is accepted and a hands-on component is recommended for CPR.
